Debtor Bankruptcy

representation in the Western District of New York State encompassing the
Rochester and Buffalo area.
Services
include analysis of the debtor's financial situation and rendering advice
to the debtor in determining whether to file a petition in Chapter 7 or
Chapter 13 bankruptcy. Preparation and filing of any petition, schedules,
statement of affairs and plan which may be required. Representation of
the debtor at the Meeting of Creditors and confirmation hearing, and any
adjourned hearings thereof.
Chapter 7 Bankruptcy:
A trustee is appointed to take over your property. Any property of value will
be sold or turned into money to pay your creditors. You may be able to keep some
personal items and possibly real estate depending on the law where you live. However,
most cases filed in this area result in the debtor losing no property, real or personal.
Chapter 13 Bankruptcy:
This chapter allows you to keep your property, but you must earn wages or have some other
source of regular income and you must agree to pay part of yout income to your creditors.
The Court must approve your repayment plan and your budget. A trustee is appointed and will
collect the payments from you, pay your creditors, and make sure that you live up to the terms
of your repayment plan.
